Are you a sharp legal mind with a flair for commercial labour and contractual law Ready to make your mark in a dynamic multi-disciplinary environment Were seeking a seasoned Legal Advisor to join a leading professional services firm operating across the built environment. Position is based in Cape Town or Gauteng.
Duties and responsibilities :
Providing general legal support to the different divisions of the company : Finance & Management Support / Management Programme / FCAs / Professional Services
Drafting of legal documentation including contract templates default notices PSP appointment letters etc. e.g. Sub-consultant PROCSA and CIDB templates and Addenda
Vetting and compliance : All legal documentation drafted on behalf of third-party fundersMonitoring ongoing litigation and disputes vetting court documentation where applicableClient liaisonAttorney liaisonLiaising with employers and / or Consultants on legal matters on behalf of Company and / or clientsAttending to registration of securities and signing of irrevocable payment undertakings and perfecting of securitiesAttending to legal correspondence with all relevant stakeholders including employers clients and third partiesAssisting with special tasks on an ad hoc basisAssist in monitoring legal risk & complianceIdentifying and managing potential legal risk
Ensuring that all suspensive conditions are met prior to Clearance being given (FMS)Ensuring that all contract documents are correctly executedAttending to recoveries and debt collectionAssist with debt collection on behalf of Company : Drafting of LOD / AOD and monitoring repayments
Setting and meeting collection targets as per agreement by CompanyAttending debt collection meetingsInstructing external attorneys per requirementAttorney liaison and responding to queries and requests for informationAssisting with trial preparation documentary evidence briefing of witnesses etc.Report on legal mattersDrafting of meeting minutes and submitting of reports to Legal Manager as required
Attending to in-house HR administrative mattersDrafting offers of employment & employment contracts
Assisting with disciplinary matters including providing guidance to staff the drafting of disciplinary documentation e.g. charge sheet / record / outcomeCCMA : Attendance of hearings / Hearing preparation & trial bundlesRedrafting of Company HR Policies : Monitoring input from external and internal stakeholders and driving to completionMonitoring performance gradings and providing guidance to the relevant ExecutiveRequirements :
LLBAdmitted attorney (Admitted Conveyancer will be advantageous)At least 5 yrs relevant post qualified experienceLabour : contracts / CCMA / DisciplinariesLitigation / court processesLegal recoveries including exposure to liquidation processes and Business RescueBasic knowledge of Contract law interpretation / drafting / vettingAdvantageous knowledge of the built environment and the following standard building contracts :JBCC 6.2
GCC (2015)NEC3 / NEC4 suite of agreementsExperience in policy reviewRequired Experience :
